Important:These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and KBahay Service(“KBahay”, “we”, “our”, “us”), a platform operating in the Republic of the Philippines. By creating an account, booking a service, or using any feature of the KBahay mobile app or website, you accept these Terms in full.
Acceptance of Terms
By downloading, installing, accessing, or using the KBahay platform (“Platform”), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy, which is incorporated herein by reference.
If you are using the Platform on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to “you” shall apply to both you and that entity.
Your continued use of the Platform after any modification to these Terms constitutes your acceptance of the revised Terms.
Definitions
For the purposes of these Terms, the following definitions apply:
- "Platform"The KBahay mobile application, website (kbahayservice.com), and all related digital services.
- "User"Any individual or entity who registers for and/or uses the Platform, including Customers, Service Providers, Rental Providers, and KTrike Drivers.
- "Customer"A User who books services, rents items, orders groceries, or requests a ride via the Platform.
- "Service Provider"A verified professional or business that offers home services, rentals, or grocery products through the Platform.
- "KTrike Driver"A verified tricycle driver registered on the Platform who provides rideshare transportation.
- "Services"All features offered through the Platform, including Home Services, Rentals, Grocery Store, KTrike Rideshare, and Solar Panel Installation.
- "Booking"A confirmed request by a Customer for a service, rental, grocery order, or ride.
- "Commission"A percentage fee retained by KBahay from each completed transaction.
- "Content"All text, images, videos, reviews, listings, and other materials uploaded to the Platform.
- "Personal Data"Information that identifies or can be used to identify an individual, as defined under RA 10173 (Data Privacy Act of 2012).
Eligibility
To use the KBahay Platform, you must meet all of the following requirements:
- Be at least eighteen (18) years of age. If you are between 13 and 17 years old, you may only use the Platform with the express consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
- Have a valid mobile phone number registered in the Philippines.
- Provide accurate, current, and complete registration information.
- Not be prohibited from receiving services under applicable Philippine law or any other applicable jurisdiction.
- Not have a previously disabled or terminated KBahay account due to violations of these Terms.
KBahay reserves the right to refuse registration or terminate accounts that do not meet eligibility requirements or that provide false information.
Account Registration
4.1 Creating an Account
To access most features of the Platform, you must register and create an account. During registration, you must provide your full name, mobile number, email address, and any other information we reasonably request for identity verification.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials. You agree to:
- Create a strong, unique password and not share it with any third party.
- Immediately notify KBahay of any unauthorized use of your account.
- Log out of your account after each session on shared or public devices.
- Accept responsibility for all activities that occur under your account, whether or not authorized by you.
4.3 Account Verification
KBahay may require additional verification for certain account types, particularly for Service Providers and KTrike Drivers, including but not limited to government-issued identification, professional licenses, vehicle registration, and background checks. Unverified accounts may have limited access to Platform features.
4.4 One Account Per User
Each individual may maintain only one (1) Customer account. Service Providers may maintain separate business accounts. Creating multiple accounts to circumvent suspensions, bans, or limitations is a violation of these Terms.
Platform Services
The KBahay Platform provides the following services, each subject to these Terms and any applicable service-specific policies:
5.1 Home Services
KBahay facilitates the booking of verified home service professionals including, but not limited to, cleaning, plumbing, electrical work, aircon servicing, appliance repair, beauty services, painting, and general repairs. KBahay acts as an intermediary and is not the direct employer of any Service Provider.
5.2 Rentals
The Rentals feature allows Customers to rent tools, equipment, appliances, furniture, and other items from verified Rental Providers. All rental agreements are between the Customer and the Rental Provider. KBahay facilitates the transaction but is not a party to the rental contract.
5.3 Grocery Store
KBahay Grocery connects Customers with local grocery stores and sellers for the purchase and delivery of food, beverages, household essentials, and other everyday products. Product availability, pricing, and delivery times are subject to the individual store’s policies.
5.4 KTrike Rideshare
KTrike is KBahay’s rideshare feature that connects Customers with verified tricycle drivers for on-demand transportation within designated service areas. See Section 11 for KTrike-specific terms.
5.5 Solar Panel Installation
KBahay facilitates inquiries and bookings for professional solar panel installation services. This service is subject to on-site assessment, product availability, and the terms of the specific solar installation provider.
5.6 Service Availability
Services may not be available in all areas or at all times. KBahay reserves the right to expand, modify, suspend, or discontinue any service at any time without prior notice, although we will make reasonable efforts to notify affected users.
Bookings & Transactions
6.1 Booking Process
A booking is created when a Customer selects a service, confirms the details (date, time, location, scope), and submits the request through the Platform. A booking is confirmed only upon acceptance by the Service Provider and successful payment processing (or scheduling of payment).
6.2 Accuracy of Information
Customers are responsible for providing accurate information when making a booking, including the service address, contact details, and any specific instructions. Inaccurate information that results in a failed or incomplete service may not be eligible for a refund.
6.3 Service Completion
The Customer is responsible for ensuring access to the property or location at the confirmed time. If a Service Provider is unable to complete a service due to Customer unavailability or inaccessibility, cancellation fees may apply.
6.4 Reviews and Ratings
After a completed booking, both Customers and Service Providers may leave reviews and ratings. Reviews must be honest, factual, and non-defamatory. KBahay reserves the right to remove reviews that violate our content guidelines.
Payments & Fees
7.1 Payment Methods
KBahay accepts payments through the following methods: GCash, Maya, credit/debit cards (Visa, Mastercard), and other payment gateways available through our payment processor, PayMongo. Cash payments may be available for certain services subject to Provider acceptance.
7.2 Pricing
Prices for all services are displayed in Philippine Peso (PHP). All prices include applicable taxes unless otherwise stated. Service Providers set their own pricing, and KBahay does not guarantee the lowest price for any service.
7.3 Commission and Platform Fees
KBahay charges a commission on each completed transaction. The commission rate is disclosed to Service Providers during the onboarding process and may be updated with 30 days’ advance notice. Customers are not charged a separate platform fee unless explicitly stated at checkout.
7.4 Payment Processing
All digital payments are processed securely through third-party payment processors. KBahay does not store complete credit or debit card information on its servers. By making a payment, you authorize KBahay to charge the applicable amount to your selected payment method.
7.5 Failed Payments
If a payment fails, the booking will not be confirmed. You will be notified of the failure and given the opportunity to use an alternative payment method. KBahay is not responsible for fees charged by your financial institution in connection with failed transactions.
Cancellations & Refunds
8.1 Customer Cancellations
Customers may cancel a booking subject to the following policy:
- Cancellation more than 24 hours before the scheduled service: Full refund.
- Cancellation within 12–24 hours of the scheduled service: 50% refund or credit.
- Cancellation within 12 hours of the scheduled service: No refund. A cancellation fee equal to 30% of the booking amount may apply.
- No-show (Customer not present at scheduled time): No refund.
8.2 Provider Cancellations
If a Service Provider cancels a confirmed booking, the Customer will receive a full refund within 3–7 business days, depending on the payment method. Repeated cancellations by a Service Provider may result in account suspension.
8.3 Refund Processing
Approved refunds will be credited to the original payment method. Refund processing times are as follows: GCash and Maya — 1–3 business days; Credit/Debit cards — 5–14 business days depending on your bank. KBahay credits may be issued as an alternative where applicable.
8.4 Non-Refundable Services
Certain services may be non-refundable once initiated. This will be clearly communicated during the booking process. Solar Panel Installation bookings have a separate cancellation policy disclosed during the inquiry process.
8.5 Disputes
If you believe a refund is owed due to poor service quality, incomplete work, or other issues, you must file a dispute through the KBahay app within 48 hours of the service completion. KBahay will investigate and resolve disputes within 7 business days.
User Conduct
9.1 Acceptable Use
You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You must not:
- Use the Platform to facilitate illegal activities or to violate any applicable Philippine law or regulation.
- Harass, threaten, discriminate against, or abuse other Users, Service Providers, or KBahay staff.
- Post false, misleading, or defamatory reviews, listings, or content.
- Use automated bots, scripts, or scraping tools to access the Platform.
- Reverse-engineer, decompile, or attempt to extract the source code of the Platform.
- Create fake accounts, impersonate another person, or misrepresent your identity.
- Circumvent or interfere with the Platform's security features.
- Use the Platform to send spam, phishing messages, or unsolicited commercial communications.
- Engage in price manipulation, booking fraud, or other deceptive practices.
- Book services with no intention of using or paying for them.
9.2 Prohibited Transactions
The Platform may not be used for any transaction involving illegal goods or services, prohibited substances, counterfeit products, or activities that are unlawful under Philippine law.
Provider Obligations
10.1 Verification Requirements
All Service Providers must complete KBahay’s verification process, which includes providing government-issued identification, professional credentials (where applicable), and agreeing to KBahay’s Provider Agreement.
10.2 Service Standards
Service Providers agree to:
- Provide services with professional skill, care, and diligence.
- Arrive at the agreed time and location.
- Bring all necessary tools and materials as agreed with the Customer.
- Maintain professional conduct and respectful behavior at all times.
- Accurately represent their skills, qualifications, and services on their profile.
- Comply with all applicable safety regulations and industry standards.
10.3 Independent Contractor Status
Service Providers are independent contractors, not employees, agents, or partners of KBahay. KBahay does not control the means or manner by which Service Providers perform their work. Providers are responsible for their own taxes, insurance, and compliance with applicable employment and professional laws.
10.4 Insurance
Service Providers are encouraged to maintain appropriate professional liability and personal accident insurance. KBahay does not provide insurance coverage for Service Providers or their activities.
KTrike Rideshare Terms
11.1 Nature of Service
KTrike connects passengers with independent tricycle drivers operating within designated barangay or municipal service areas. KBahay is a technology platform and is not a transportation company. KTrike Drivers are independent operators, not employees of KBahay.
11.2 Driver Requirements
KTrike Drivers must hold a valid Philippine driver’s license, maintain a registered and roadworthy tricycle, pass KBahay’s background screening, and comply with all applicable LTFRB and LTO regulations.
11.3 Passenger Safety
Passengers must comply with all applicable traffic safety rules, including wearing a helmet if required. Passengers must not direct drivers to violate traffic laws or take unsafe routes. KBahay reserves the right to suspend passengers who repeatedly receive poor conduct ratings from drivers.
11.4 Fare Calculation
KTrike fares are calculated based on distance, time, and applicable surge pricing. The estimated fare is displayed before booking confirmation. The final fare may vary slightly due to actual route taken or waiting time.
11.5 Liability
KBahay does not assume liability for accidents, injuries, or losses that occur during a KTrike trip. Passengers and drivers agree to resolve any disputes directly and to report incidents to KBahay within 24 hours for documentation purposes.
User-Generated Content
By submitting reviews, photos, listings, messages, or any other content to the Platform, you grant KBahay a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute such content on the Platform and in our marketing materials.
You represent and warrant that any content you submit does not violate the intellectual property rights, privacy rights, or other rights of any third party, and does not contain defamatory, obscene, or otherwise unlawful material.
KBahay reserves the right, but not the obligation, to review, edit, or remove any user-generated content that violates these Terms or our content guidelines.
Intellectual Property
13.1 KBahay Ownership
The KBahay Platform, including its name, logo, design, software, features, and all content created by KBahay, is owned by KBahay Service and protected by copyright, trademark, and other intellectual property laws of the Philippines and international conventions.
13.2 Limited License to Users
Subject to your compliance with these Terms, KBahay grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.
13.3 Trademarks
KBahay, KTrike, and associated logos are trademarks of KBahay Service. You may not use these trademarks in any manner that could cause confusion or that disparages KBahay.
Disclaimers & Warranties
THE KBAHAY PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE PHILIPPINE LAW, KBAHAY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
- Warranties regarding the quality, safety, suitability, or reliability of any services performed by Service Providers.
- Warranties regarding the accuracy, completeness, or timeliness of any content on the Platform.
KBahay does not endorse, verify, or guarantee the competence, licensing, or quality of any Service Provider. Customers should exercise their own due diligence when selecting a provider.
Limitation of Liability
To the maximum extent permitted by applicable law, KBahay and its directors, officers, employees, and agents shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, goodwill, or business opportunities.
- Damages resulting from the acts or omissions of Service Providers, Rental Providers, or KTrike Drivers.
- Damages arising from your reliance on information provided on the Platform.
- Damages from unauthorized access to or alteration of your transmissions or data.
In no event shall KBahay’s total liability to you for all claims arising from or related to your use of the Platform exceed the total amount paid by you to KBahay in the three (3) months preceding the claim.
Some jurisdictions do not allow certain limitations of liability. In such cases, the above limitations will apply to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless KBahay and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of or access to the Platform.
- Your violation of these Terms or any applicable law.
- Your violation of any third-party right, including intellectual property or privacy rights.
- Any content you submit to the Platform.
- Any harm caused by your interactions with Service Providers, other Users, or KTrike Drivers.
Third-Party Services
The Platform may integrate with or link to third-party services, including payment gateways (PayMongo), mapping services (Google Maps), messaging services, and social media platforms. These third-party services are governed by their own terms and privacy policies, and KBahay is not responsible for their content, availability, or practices.
Your use of third-party payment services is subject to those providers’ terms. KBahay is not liable for any disputes, failures, or losses arising from third-party payment processing.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines, specifically including but not limited to:
- Republic Act No. 10173 (Data Privacy Act of 2012)
- Republic Act No. 8792 (Electronic Commerce Act of 2000)
- Republic Act No. 7394 (Consumer Act of the Philippines)
- Republic Act No. 10175 (Cybercrime Prevention Act of 2012)
- The Civil Code of the Philippines
Any dispute shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.
Dispute Resolution
19.1 Informal Resolution
Before filing a formal legal claim, you agree to attempt to resolve any dispute informally by contacting KBahay at legal@kbahayservice.com. We will attempt to resolve the dispute within thirty (30) calendar days.
19.2 Mediation
If informal resolution fails, both parties agree to participate in good-faith mediation before pursuing litigation, using a mutually agreed-upon mediator or through the Philippine Mediation Center.
19.3 Arbitration
Any unresolved dispute arising from these Terms may be submitted to binding arbitration in accordance with the Alternative Dispute Resolution Act of 2004 (RA 9285), conducted in Metro Manila, Philippines, in the English language.
19.4 Class Action Waiver
To the extent permitted by law, you waive any right to bring claims against KBahay as a class action, consolidated, or representative proceeding.
Termination
20.1 Termination by You
You may terminate your KBahay account at any time by requesting account deletion through the app settings or by contacting support@kbahayservice.com. Upon termination, your right to use the Platform ceases immediately.
20.2 Termination by KBahay
KBahay may suspend or permanently terminate your account, without prior notice, if you:
- Violate any provision of these Terms.
- Engage in fraudulent, abusive, or illegal activities.
- Receive repeated complaints from other users or providers.
- Fail to pay amounts owed to KBahay.
- Pose a risk to the safety or security of other users, providers, or the Platform.
20.3 Effect of Termination
Upon termination, any pending bookings may be cancelled. Refunds for prepaid services will be processed in accordance with our Cancellations and Refunds policy. Provisions of these Terms that by their nature should survive termination shall continue to apply.
Changes to These Terms
KBahay reserves the right to modify these Terms at any time. We will notify registered users of material changes via push notification, email, or prominent in-app notice at least fourteen (14) days before the changes take effect, unless changes are required immediately by law.
Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Platform and may request account deletion.
